Hello,
I was once in the same situation for H1 ( moved to a new compan ), where ex-emplyoyer totally denied to give letter. My lawyer suggested to just write a letter to USCIS mentioning that ex-employer is not giving letter and also mention his company name and telephone number, where they can call and check if they wish. If you have paystubs for the said working period attach copies with this letter.
WE did this, and we got our H1 approved and also I-140 got cleared.
Please check with your lawyer before you follow this step as I am not a lawyer.
Hope this helps and All the best...

you would have to specify that when you apply for the AP. Look at part 7 item 2 in the application.
NO, that part applies to a person applying for Advance Parole (humanitarian reason) and not Advance Parole (baed on peding I-485).
This confusion is because the form is used for multiple application type - Rentry Permit, Refugee Travel Document, Advance Parole (humanitarian and I-485 pending). I think USCIS should redesign separate form for each application type to remove the confusion.
If your AP is based on a pending I-485 you must be in the US to apply and receive the approval. If you need to travel before the approval, you could go to a local USCIS office to expedite the application.

When one should feel to donate, they can donate. Doesn't mean that you donated, means everyone should donate.
It is about donation, not Haptaa-vasooli.....
So, before taunting anyone you should understand the meaning of "Donation".
If some one directs a post to you and asks you directly about whether you donated or not then you can then send out posts of the above kind
In the mean time if you believe in the cause donate else dont but there is no use arguing about pros/cons and definition of donation per se or difference between donation and contribution.

Congrats!! And 6 months more of working for a bad employer is a small price to pay in the big picture. And there are lots of creative ways to kill 180 days. Cut your productivity and actively engage in finding a good job... take paternity vacations etc.

misdemeanors can be CIMT's if they involve theft or dishonesty. a single misdemeanor might qualify under the petty offense exception, but because your son now faces a second conviction, the petty offense exception won't apply. One question: are you a naturalized US citizen? If so, your son might actually be a US citizen as well.
does not the INTENT to cause harm or INTENT to steal decide whether its a CMT?
He has on record 1 criminal mischief 4th and 1 petty larceny - he was with other boys when THEY joy rided snowmobiles - he did not steal anything just tagged along with them and rode with them but he did not intend to steal or take anything - both the criminal mischief and petty larceny charges are tied into this incident:
His latest charge will be reduced to a simple TRESSPASS from Burglary 2nd we know that as the DA has already indicated that to us:
So does this information make any difference to your opinion?
I thank you for responding!
He is a green card holder since December 2005 and eligible for filing naturalization in November next year but we have been physically present in the USA from 1999 gained entry legally and changed status while here:
He has no priors to any of this:
He has no convictions in any other country:
His mischief and petty larceny charges for the snow mobile incidents were charged as a youthful offender and sealed supposedly:
He is 19 in November this year:
He has never left the USA for any period of time or vacation or anything

There are no plans for extended vacation.
I thought the 3 year h1b extension after 140 approval is a one time deal and there would be no further extensions  .
I am not aware of the 12yr lifetime H1B limit. Can some one shed some light on this?

Dear friends,
I entered to US on 5th October 2009 on B1 visa and at POE I was given 3 months duration to stay.
I came here to write physical therapy licensing exam on 8th OCT (same is mentioned as an annotation on my B1 visa) and now I passed the exam and licensed.
Now a hospital is ready to file a H1B work visa for me through premium processing and they want me to start working for them immediately after the approval of H1B.
Other relevant past details are
H1B non cap petition- June 2008
221 g at the consulate for the H1B petition since I didn't had the license.
Hospital withdrew the H1B petition in August 2008.
Dear friends, kindly let me know whether its safe to change the status within 15 days of my entry(its a different hospital). And if not how many days should I delay the filing of H1B. I would like to change the status here without going back to my country for H1B.
And also whether this will have any future adverse effect when I file the immigrant petition. Thank you very much for your valuable advise in advance.John

Thks for your prompt response snathan, but I've been getting paystub from my new employer Company B (so far I've got 2 paystubs) so in this case I can't possibly getting Pay Stubs from both Company A & B right?
The act suggested in the post above is illegal.
Your work with Company B is also illegal. You cannot start working for a different company until you have the H1-B petition submission receipt.
Your simplest and recommended course of action is to go out of the country and come back again. This will cause you least grief. But as you know, that course of action does entail the risk that your visa application could be denied.

I recently got this job at a check printing (http://www.chequeprint.ca/check-printing.php) company in the US. They create custom made business checks (http://www.chequeprint.ca/check-printing.php). The catch is that i need to take care of all my visa procedures myself. What are the procedures involved with regard to medical exams? Can anybody please help me out with this?

Did you last stamped in Tijuana? Because Rule is just changed.
NEW RULE:
Visa Stamping from Canada/Mexico - Read and post experiences : Page 0 (http://www..com/experience/readentries.do?category=22)
You can have H1B stamping in Tijuana, only if you had last stamped in Tijuana.
Here is the OFFICIAL link from US Consulate at Tijuana
Visa Services (http://tijuana.usconsulate.gov/niv.html)
Who Can Apply in Mexico
TCN Applicants residing in the United States, seeking to renew their visa in any category except B1/2 (tourist/business), if the current visa was issued in the applicant's country of nationality, former residence, or in Mexico. A spouse or dependent children may apply with the principal visa holder if the principal meets the criteria above. A renewal is a case where an applicant for the same type of visa is made and does not include persons who seek to change from one visa category to another or who are seeking any other type of change of status even if that change has been authorized by the Department of Homeland Security.

Thx for your reply.
But this wasn't told to me (us) by my company's hr, I guess I got to check that advise for second opinion.
I dont know what your comapny lawyer(you say HR they are least qualified for such advices in majority of situation) told you, but i know that you must posses the AP document in hand before u leave the country to use it for reentry. I think ur wife will recieve the passport soon ( this is due to glitch in the new PIMS verfication system) .You cant do much in this situation but just be paitient.
